By accessing or using our platform, you agree to be bound by these Terms and Conditions. These Terms constitute a legally binding agreement between you ("User," "Freelancer," or "Client") and HudumaPortal ("we," "us," or "the Platform"). 1. Acceptance of Terms

By registering for an account, browsing, or using the services provided by HudumaPortal, you acknowledge that you have read, understood, and agree to comply with these Terms. If you do not agree to these Terms, you may not use our platform.

  • "Platform": The HudumaPortal website and associated mobile applications.

  • "User": Any individual or entity using HudumaPortal, including freelancers and clients.

  • "Freelancer": A user offering services on the Platform.

  • "Client": A user posting jobs or hiring freelancers on the Platform.

  • "Services": Tasks or projects provided by freelancers and purchased by clients.

3. Eligibility

To use HudumaPortal, you must meet the following criteria:

  • Be at least 18 years old or of legal age in your jurisdiction.


  • Provide accurate, up-to-date, and complete information during registration.


  • Comply with all applicable laws, rules, and regulations of The United Republic of Tanzania when using the Platform.



HudumaPortal reserves the right to suspend or terminate accounts if eligibility criteria are not met.

4. Registration and Account Responsibilities

  • Users must create an account to access HudumaPortal’s services.

  • You are responsible for maintaining the confidentiality of your account credentials.

  • Sharing login credentials or impersonating another user is strictly prohibited.

  • You agree to update your account information promptly in case of changes.

5. Posting Projects and Offering Services

For Clients:

  • Clients are responsible for posting accurate, lawful, and detailed job descriptions.

  • You agree to communicate and collaborate with freelancers solely through the Platform.


For Freelancers:

  • Freelancers must ensure their profiles are accurate and represent their skills truthfully.

  • Services offered must comply with applicable laws and these Terms.


HudumaPortal is not responsible for the accuracy or legality of job postings or freelancer profiles.

6. Payments and Fees

HudumaPortal uses a secure Flutterwave system to manage payments. The Platform supports popular payment methods in Tanzania, such as M-Pesa, Mix by Yas, Halopesa and Airtel Money. HudumaPortal ensures secure, transparent, and efficient transactions between freelancers and clients. Below is a detailed breakdown of how payments and fees work on the platform:

6.1. Payment Process

A. For Clients (How to Pay Freelancers)

1. Adding Funds


  • Clients can deposit money into their HudumaPortal wallet using mobile money (M-Pesa, Mix by Yas, Halopesa and Airtel Money). Then use the deposited funds to pay for the service or hire a Freelancer. Or Clients may decide to pay directly without depositing to the wallet.


2. HudumaPortal Escrow System (Secure Payments)

  • When a client hires a freelancer or books a service, the agreed payment is held in escrow system.

  • The freelancer starts working once funds are confirmed.

  • Payment is only released when the client approves the work.



3. Releasing Payment

  • Once the freelancer delivers work, the client reviews it.

  • If satisfied, the client releases payment.

  • If there is a dispute, HudumaPortal's Dispute Resolution Center can mediate.

B. For Freelancers (Receiving Payments)

1. Earnings and Withdrawals

Once a client releases payment, funds are available in the freelancer’s Balance.

Freelancers can request withdraw earnings through:

  • Mobile money (M-Pesa, Tigo Pesa, Airtel Money).

  • Bank transfer. (NMB and CRDB)


Minimum withdrawal limit: 10,000 TZS 

Withdrawals typically take 8 hours for processing.

6.2. HudumaPortal Admin Fees

A. Fees for Freelancers

HudumaPortal charges a commission on each completed project to maintain the platform and provide services like dispute resolution and customer support.

Example:

If a freelancer earns 10,000 TSH from a client, HudumaPortal  takes 10% (1,000TSH), and the freelancer receives 9,000TSH.


Withdrawal Fees:

Mobile Money: 1-3% of the withdrawal amount.

Bank Transfer: Flat rate of 1000 TZS.



B. Fees for Clients

Clients can post jobs for free but may choose optional paid features:

Transaction Fees:

Clients covering payment processing fees (depends on the method used).

HudumaPortal does not charge clients directly, but they must pay before hiring or booking a service.

6.3. Refunds and Dispute Resolution

  • Full Refunds: If a freelancer fails to deliver as per agreement, the client can request a full refund before work is marked as complete.

  • Partial Refunds: If some work has been done, HudumaPortal can mediate a partial refund.

  • No Refunds: If a job is completed and approved, refunds are not possible.

In addition to commission fees, freelancers can opt for paid membership plans for added benefits like jobs notification, promoted Ads, social media promotion, admin fee cashback, weekly insights report, increased visibility and many more.

6.5. Taxes and Legal Compliance

Freelancers are responsible for their own taxes. HudumaPortal does not deduct taxes from earnings.

Clients must ensure compliance with Tanzanian tax laws for hiring freelancers.

HudumaPortal provides earning statements for freelancers to use for tax filing.

7.0. Dispute Resolution

If a dispute arises between a client and a freelancer, both parties agree to attempt to resolve it amicably. Unresolved disputes can be escalated to HudumaPortal’s internal dispute resolution team. HudumaPortal reserves the right to make a final and binding decision in disputes.

At HudumaPortal, we aim to provide a fair and transparent platform for freelancers and clients to collaborate. Disputes may arise due to misunderstandings or unmet expectations. Below are the steps to resolve disputes effectively:

7.1. Prevention First: Clear Communication

Define Expectations Early: Clearly outline project requirements, deliverables, timelines, and payment terms before starting work.

Use the Platform Tools: Communicate, share files, and track progress within HudumaPortal’s messaging and project management system for record-keeping.

Agree on Milestones: Break the project into milestones and ensure both parties approve before moving forward.

7.2. Direct Negotiation

Step 1:


  • Discuss the Issue Privately: Use HudumaPortal’s messaging system to raise concerns directly with the other party.

  • Freelancers: Politely explain your work and respond to client feedback.

  • Clients: Clearly describe your dissatisfaction or unmet expectations.


Step 2:

  • Review Agreements: Refer to the initial job description, terms, or milestone agreements to clarify misunderstandings.

Step 3:

  • Propose Solutions: Be flexible and propose compromises (e.g., revisions, partial payments, or adjusted deadlines).

7.3. HudumaPortal Mediation Process

If direct negotiation fails, HudumaPortal offers a Dispute Resolution Center to mediate.

Step 1: Open a Dispute:

  • Navigate to the project page and select “Report.”

  • Provide detailed information, including service or job details, communication logs, and supporting evidence (e.g., screenshots or files).


Step 2: HudumaPortal Review:

  • A neutral mediator from HudumaPortal will review the submitted evidence and communication history.

  • Both parties will be asked to present their case in a fair and respectful manner.


Step 3: Decision:

  • The mediator will issue a decision based on the evidence provided.

  • Dispute outcomes may include refunds, partial payments, or revised project terms.

HudumaPortal’s decision is final to ensure fairness and protect the integrity of the platform.

7.4. Payment-Related Disputes

If a dispute involves payment:

  • Funds provided by client will remain frozen until the dispute is resolved.

  • If a freelancer fails to deliver as agreed, the client may receive a refund.

  • If the client is satisfied with part of the work, partial payments may be released.

7.5. General Guidelines

  • Be Respectful: Maintain professional communication at all times.

  • Provide Evidence: Keep detailed records of agreements, messages, and submitted work for reference in case of a dispute.

  • Follow Deadlines: Both parties should adhere to agreed-upon timelines to avoid disputes.

7.6. Grounds for Disputes

Common issues eligible for dispute resolution include:

  • Failure to deliver agreed-upon work or milestones.

  • Misrepresentation of skills or deliverables.

  • Refusal to approve the service when work is done.

  • Unapproved changes to project scope or timeline.

7.7. Cases Outside HudumaPortal’s Scope

HudumaPortal may NOT handle disputes related to:

  • Communication or transactions conducted outside the platform.

  • Personal disagreements unrelated to the project.

7.8. Penalties for Unethical Behavior

Users engaging in fraudulent activities, harassment, or consistent disputes may face:

  • Temporary or permanent account suspension.

  • Forfeiture of payments provided.

  • Legal action if necessary.


Remember: HudumaPortal is committed to fostering trust and professionalism. By adhering to these guidelines, freelancers and clients can build strong and lasting working relationships.

8. User Conduct

Users agree to:

  • Use the Platform for lawful purposes only.

  • Not engage in fraudulent, harmful, or abusive behavior.

  • Not share personal contact information or conduct transactions outside the Platform.


HudumaPortal reserves the right to suspend or terminate accounts for any violations.

9. Intellectual Property Rights

  • Users retain ownership of the content they create, including job postings and delivered work.

  • By using the Platform, you grant HudumaPortal a non-exclusive, royalty-free license to use, display, and promote your content for operational purposes.

  • Users may not copy, reproduce, or distribute any content or materials belonging to HudumaPortal without explicit permission.

10. Confidentiality and Data Protection

  • HudumaPortal is committed to protecting your personal information in compliance with applicable data protection laws.

  • Users must maintain the confidentiality of private communications and project-related information.

  • HudumaPortal is not liable for unauthorized access to user accounts caused by negligence.

11. Limitation of Liability

  • HudumaPortal is NOT responsible for the quality, accuracy, or completion of services provided by freelancers.

  • HudumaPortal does NOT guarantee project outcomes or the satisfaction of clients and freelancers.

  • In NO event will HudumaPortal be liable for indirect, incidental, or consequential damages arising from the use of the Platform.

12. Termination of Services

HudumaPortal reserves the right to suspend, terminate, or restrict user access to the Platform at its sole discretion for any violations of these Terms.

Users may deactivate their accounts at any time by following the instructions provided on the Platform.

HudumaPortal may update these Terms or make changes to the Platform at any time without prior notice. Users are encouraged to review these Terms regularly. Continued use of the Platform constitutes acceptance of any updated Terms.
